By the 1920’s, the administration of music rights had become a major business. The American Society of Composers, Artists, and Publishers (ASCAP) was founded, serving as a member-owned organization to fight for fair compensation when recorded work was publicly performed.

While radio stations could license programming for personal performance, they could not track where music was being played and take responsibility for its licensing. Muzak’s business model, however, was ideal for this task. Because every Muzak receiver could be uniquely identified, it was easy for Muzak to track who was using their service and what the service was being used for.

In the late 1930’s Muzak moved to New York City and began to cater to the hotel and restaurant market in such famed venues as the Chambord, the Stork Club, and the Waldorf Astoria. Audio would subsequently be sent to clubs through leased telephone lines. Speakers would be hidden amongst large plants, thereby making the music seem to come out of nowhere and lending the name “potted palm” music. With the disappearance of any visible means of sound production, Muzak exceeded the gramophone’s capacity to make sound autonomous. In delivering programming to the workplace, Muzak soothed the minds of employees, enhancing their productivity while eliminating the distractions caused by commercials, scripted programs, and other verbal content.

Sending music to the workplace was in keeping with the vision that General George Squier had left for the company. As Chief Signal Officer of the US Army Signal Corps, Gen. Squier used music to increase the productivity of his secretaries. Afterward, he investigated ways that music could recapture the benefits of pre-industrial song, in order to soothe the nerves of employees while increasing their output. The idea of using music to improve an environment was not uncommon by the 1930s, when dentists employed music to augment or even replace anesthetic. Even though a compliment to the power of music, I wouldn’t try this at home!

Muzak soon proved effective in locations beyond the office or factory floor. As skyscrapers reached ever taller in North American cities, building owners employed Muzak to calm anxious elevator riders; quickly earning its programs the name “elevator music.”

1934: The First Year

So off into the world of Muzak archives we go, to our earliest recording sessions. We know the names of nearly all of the musicians and the songs they recorded on specific dates thanks we call our ‘Blue Books’. These books are filled with session charts or stage reports that document the date, band leader, number of musicians, studio, engineer, master number, composer, publisher, and titles recorded at each Muzak session.

Our earliest stage reports from 1934 lack some of the information registered in later sessions, but they still give us an unprecedented look into the past. A picture of one of the very first stage reports is captured at left.

Our records show that one of the first Muzak recording sessions featured a touring Italian brass band called the ‘National Fascist Militia Band’. Yes folks, this was just prior to WWII and the band was Mussolini’s own Italian marching band, with their American tour scheduled in mid 1934. The tour’s slogan was “Uniting the Hearts of Italy and America”. Turns out that Mussolini also booked his band in Nazi Germany. During the National Fascist Militia Band’s one and only American tour in the summer of ’34, Carnegie Hall was one of their first stops, followed by a visit to Muzak’s sound studio in Manhattan.

At this session Muzak’s producer Ben Selvin, recorded over 25 songs and marches, including: To Arms (Fascist Anthem), Royal Italian March, the Meistersinger Overture, the William Tell Overture and the Star Spangled Banner (ironic). I’m not sure how often these recordings were played after the war began, but they sure made a power musical statement as part of Muzak’s initial library. After hearing these recordings, current producer and Muzak digitizing expert Joe Carter concludes that they are true masterpieces performed by exquisite musicians.

In 1934 we also recorded the likes of the Metropolitan Opera, Joe Venuti’s Orchestra (renowned jazz violinists, featuring vocalist Louie Prima in “Confessing”, found on our 75th website), Harold Kemp and his Orchestra (first “sweet” dance band), Frank Luther Quintet (legendary Hilly Billy band leader), Edwin Franco Goldman Band (renowned military band that played for over 90 years), the St. Bartholomew Choir, and the Harry Salter Orchestra (played with Gene Krupa, Jimmy and Tommy Dorsey, Artie Shaw and Jack Teagarden). All in all during 1934, over 250 tracks in 7 different music genres were recorded by Muzak’s producer extraordinaire, Ben Selvin. Not bad for a company in their first year of operation.

We are currently digitizing many of these tracks from Muzak’s 1934 archive and are excited to give you a taste over the next few weeks. Stay tuned!

“Greg Cagle and Rick Nash lead the charge…This is a solid session with meaningful lyrics and music that sticks to your ribs…This team based in Charlotte, NC is worth listening to.” – D. Oscar Groomes – O’s Place Jazz - review of Soul Complete

Charlotte, NC -May 12, 2010 – Hot off the heels of their debut album Soul Complete, North Carolina-based songwriting duo Cagle & Nash are back from the studio with their sophomore release – Loungevity. From the moment you pick up the disc and see the album art adorned with pics of sunglasses and cocktail bars, it’s clear that Greg Cagle (lead vox, guitar) and Rick Nash (horns) have taken the lounge aesthetic to heart for this album. And the pair don’t disappoint, with 11 smooth and soulful new tracks spanning a range of cocktail-friendly genres.

The overall vibe of Loungevity fits in the jet-set philosophy of the classic Space Age Pop and Lounge acts from the ‘50s and ‘60s. There are the lush horn and string arrangements, topped with Cagle’s smooth baritone and accented by tight female background vocals. But Cagle & Nash also add a bit of funk and bite to the mix, drawing influences from late ‘70s acts like STEELY DAN and CHICAGO.

Loungevity begins with the upbeat and radio-friendly “Straight to L.A.,” a perfect track to start any day. “Black Tie Affair” tells tales of the good life, spent behind the bar with a cocktail in one hand and a stack of money in the other. “If Only” and “Mmm Paradise” draw influences from the smooth bossa-nova vibe, while “A Little Bit of Attention” is a full-on funk jam. All-around, Cagle & Nash tackle each genre with masterful execution, both in terms of songwriting and arrangement. The playing is top-notch and the record exudes a certain class and sophistication.

The duo of Rick Nash and Greg Cagle first got their start back in the ‘60s, playing in bands near their hometown in North Carolina, most notably in the band Sugarcreek. Fast forward to the ‘80s and the duo reunited to begin composing and recording songs. Rick and Greg worked together on and off until 2008, when they officially united to form the duo Cagle & Nash. In 2009 they released their debut album Soul Complete, which was received well by both radio and press. O’s Place Jazz Newsletter even named the record one of the Best Albums of 2009. Now, with the release of Loungevity the duo are back on the scene and ready keep making music.

###

Please check out Cagle and Nash’s sophomore release Loungevity for a full dose of smooth music and laid-back vibes. If you have any questions, comments or would like to set up an interview don’t hesitate to contact Rob Phillips at Powderfinger Promotions.
“Loungevity” is songwriting producing duo Cagle & Nash’s second release in less than a year following hot on the heels of their first joint project “Soul Complete”. Well that is unless you count their holiday single release “Celebrate the Holidays”

The title Loungevity” is a play on the word Longevity that only serves to indicate the mood and tone of these 11 songs. Each of them is crafted uniquely, the lack of a theme is intentional, the intent more to deliver some of the duo’s best arrangement and production yet. Songs from this CD like “If Only”, “I Don’t Mind” and “Big Ol’ Empty Room” are destined to receive airplay across at least three genres (smooth Jazz, Soul/R&B and Pop). The a cappella song “You Remind Me” (except for piano) is a cross between McFerrin and Take 6 with a nice poignant lyric and all vocals supplied by Greg Cagle. Very hip! Very cool! The leadoff track “Straight to LA” delivers plenty of punch and puts the “it’s a brand new day” attitude in your mind. Refreshing! “The Grass was Always Greener” is another up-tempo tune with a full horn section kicking butt and some great solos by Jon Thornton on trumpet, Tim Gordon on alto sax and the none other than French jazz guitarist Daniel Domenge.

This project consists of an all-star line-up of David Rhyne, David Floyd of Floyd’s Produce, Kenneth Leonard Jr (of Anthony Hamilton band) Jon Thornton and Tim Gordon and a host of others accompanying Greg Cagle and Rick Nash. Little exquisite touches of Robyn Springer and host of others on background vocals. Arrangements are Cagle, Nash and Bobby Aycock and both Cagle & Nash share Production. All compositions are co-penned by Cagle and Nash.

Greg Cagle and Rick Nash grew up in small town Concord (NC) back when it was hip to listen to cats like James Brown, Sam & Dave, Otis Redding, Wilson Picket, the Four Tops, and The Temptations. Cagle & Nash crossed paths for the first time at the young ages of 15 and16 respectively. Back then they called them “basement” bands—Doug & The Soul Review, The Tamrons and a host of others. Then there were the “working” bands like Sugarcreek where both Greg and Rick played on more than one occasion. Cagle continued to build his catalog of original material and honed his composing and arranging skills. Meanwhile Nash went on to study studio recording and production under none other than Mark Williams (engineer on projects of R.E.M., Don Dixon, and James Brown fame).

Fast forward to late December when they began work on their critically acclaimed CD project entitled “Soul Complete” which was 11 sons that were each singles in their own right with R&B genre chart action in Cashbox Magazine and Smooth Jazz chart action on smoothjazz.com’s Indie Charts. That release was immediately followed by a Christmas season release “Celebrate the Holidays”

This newest release “Loungevity” is being targeted to those same markets as “Soul Complete” was and is taking the song arrangement and production up a new level for Cagle & Nash. Expect more good things with two additional releases in the works

February 1, 2009

We Just uploaded to the MySpace page, the final mixes to six tracks from the “Soul Complete” CD which has a scheduled release date of Mid-February. Please give them a listen – we would love to have your feedback. You can check out samples of all 12 tracks on our website: http://www.cagleandnash.com

These 12 tracks have been compared lots of different artists but we like to think it was all those influences throughout our musical lives have been a huge part of where our own unique sound comes from.

Some really good friends of ours have lent a tremendous amount of talent to the Soul Complete project. We had our friend Kenneth Leonard Jr. (of Anthony Hamilton’s touring band) lend some awesome piano and organ chops to the project. Bill Baucom, Larry Farber and Bobby Aycock played some excellent keyboard stuff on the project as well. Sax players? Of Course! Greg played a big majority of the sax tracks but we had some really fills by Larry Gianneschi and awesome Alto sax work on solos and parts from Zach Wheeler of The Entertainers and Chris Mitchell (incredible sax talent who is still a high school student). Some really funky and tight drumming on the project from Tovaris Matthews, Steve McGuirt and Dave Rhyne (who also engineered the whole project). Joe Mier played some tight funky bass on a big majority of these tracks. If you haven’t heard of these cats, trust me you will.

Stay tuned, as we get closer to our anticipated late February CD Release. You will be able to purchase from CD Baby, iTunes, Rhapsody, Amazon MP3, and a host of others.

Meanwhile you can catch the Greg Cagle Acoustic Sets regularly at Dolcetto Wine Room in Charlotte on every Friday & Saturday night.

This is a brief excerpt from an article written by Janis Ian for Performing Songwriter Magazine, May 2002
I apologize Ms. Ian for not publishing this article in its entirety but due to space limitations I will paste this hyperlink to the full article. http://www.janisian.com/article-internet_debacle.html

Excerpted . . .

“If you think about it, the music industry should be rejoicing at this new technological advance! Here’s a fool-proof way to deliver music to millions who might otherwise never purchase a CD in a store. The cross-marketing opportunities are unbelievable. It’s instantaneous, costs are minimal, shipping nonexistant…a staggering vehicle for higher earnings and lower costs. Instead, they’re running around like chickens with their heads cut off, bleeding on everyone and making no sense. As an alternative to encrypting everything, and tying up money for years (potentially decades) fighting consumer suits demanding their first amendment rights be protected (which have always gone to the consumer, as witness the availability of blank and unencrypted VHS tapes and casettes), why not take a tip from book publishers and writers?

Baen Free Library is one success story. SFWA is another. The SFWA site is one of the best out there for hands-on advice to writers, featuring in depth articles about everything from agent and publisher scams, to a continuously updated series of reports on various intellectual property issues. More important, many of the science fiction writers it represents have been heavily involved in the Internet since its inception. Each year, when the science fiction community votes for the Hugo and Nebula Awards (their equivalent of the Grammys), most of the works nominated are put on the site in their entirety, allowing voters and non-voters the opportunity to peruse them. Free. If you are a member or associate (at a nominal fee), you have access to even more works. The site is also full of links to members’ own web pages and on-line stories, even when they aren’t nominated for anything. Reading this material, again for free, allows browsers to figure out which writers they want to find more of – and buy their books. Wouldn’t it be nice if all the records nominated for awards each year were available for free downloading, even if it were only the winners? People who hadn’t bought the albums might actually listen to the singles, then go out and purchase the records.

I have no objection to Greene et al trying to protect the record labels, who are the ones fomenting this hysteria. RIAA is funded by them. NARAS is supported by them. However, I object violently to the pretense that they are in any way doing this for our benefit. If they really wanted to do something for the great majority of artists, who eke out a living against all odds, they could tackle some of the real issues facing us:

The normal industry contract is for seven albums, with no end date, which would be considered at best indentured servitude (and at worst slavery) in any other business. In fact, it would be illegal.

A label can shelve your project, then extend your contract by one more album because what you turned in was “commercially or artistically unacceptable”. They alone determine that criteria.

Singer-songwriters have to accept the “Controlled Composition Clause” (which dictates that they’ll be paid only 75% of the rates set by Congress in publishing royalties) for any major or subsidiary label recording contract, or lose the contract. Simply put, the clause demanded by the labels provides that a) if you write your own songs, you will only be paid 3/4 of what Congress has told the record companies they must pay you, and b) if you co-write, you will use your “best efforts” to ensure that other songwriters accept the 75% rate as well. If they refuse, you must agree to make up the difference out of your share.

Congressionally set writer/publisher royalties have risen from their 1960′s high (2 cents per side) to a munificent 8 cents.

Many of us began in the 50′s and 60′s; our records are still in release, and we’re still being paid royalty rates of 2% (if anything) on them.

If we’re not songwriters, and not hugely successful commercially (as in platinum-plus), we don’t make a dime off our recordings. Recording industry accounting procedures are right up there with films.

Worse yet, when records go out-of-print, we don’t get them back! We can’t even take them to another company. Careers have been deliberately killed in this manner, with the record company refusing to release product or allow the artist to take it somewhere else.

And because a record label “owns” your voice for the duration of the contract, you can’t go somewhere else and re-record those same songs they turned down.

And because of the re-record provision, even after your contract is over, you can’t record those songs for someone else for years, and sometimes decades.

Last but not least, America is the only country I am aware of that pays no live performance royalties to songwriters. In Europe, Japan, Australia, when you finish a show, you turn your set list in to the promoter, who files it with the appropriate organization, and then pays a small royalty per song to the writer. It costs the singer nothing, the rates are based on venue size, and it ensures that writers whose songs no longer get airplay, but are still performed widely, can continue receiving the benefit from those songs.

Additionally, we should be speaking up, and Congress should be listening. At this point they’re only hearing from multi-platinum acts. What about someone like Ani Difranco, one of the most trusted voices in college entertainment today? What about those of us who live most of our lives outside the big corporate system, and who might have very different views on the subject?
There is zero evidence that material available for free online downloading is financially harming anyone. In fact, most of the hard evidence is to the contrary.
Greene and the RIAA are correct in one thing – these are times of great change in our industry. But at a time when there are arguably only four record labels left in America (Sony, AOL/Time/Warner, Universal, BMG – and where is the RICO act when we need it?)… when entire genres are glorifying the gangster mentality and losing their biggest voices to violence…when executives change positions as often as Zsa Zsa Gabor changed clothes, and “A&R” has become a euphemism for “Absent & Redundant”… well, we have other things to worry about.
It’s absurd for us, as artists, to sanction – or countenance – the shutting down of something like this. It’s sheer stupidity to rejoice at the Napster decision. Short-sighted, and ignorant.
